Please read these Terms of Service ("Terms") carefully. By accessing or using the services provided by Kosaform ("Company," "we," "us," or "our") through our website, platform, and mobile applications (collectively, the "Service"), you agree to be bound by these Terms and all incorporated policies.
By creating an account, subscribing to a plan, or launching a survey campaign on the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you may not use the Service.
The Service provides an AI-powered platform for market research, allowing users to (a) create, design, and analyze surveys, and (b) procure or "Rent Targeted Respondents" from our validated network for a fee ("Respondent Access").
You must be at least 18 years old and capable of entering into a binding contract to use the Service.
Access to certain features (e.g., editing, viewing dashboards) is restricted by your subscription plan's Workspace Member limit. This limit applies only to internal team members invited to collaborate and does not include external survey respondents.
All payments for monthly subscriptions and funding the User Wallet must be processed exclusively through PayPal. We do not accept credit cards, bank transfers, or any other payment methods directly.
Subscription fees are billed monthly and provide access to platform tools (AI Builder, analytics, etc.). You must cancel your subscription before the next billing date to avoid charges.
- Funding: You must pre-fund your User Wallet via PayPal to launch a respondent renting campaign.
- Respondent Fees: The final fee for Respondent Renting is the Reward Amount you set per response, multiplied by the number of verified responses received. This price includes a 20% Platform Fee retained by us to cover technology and payment processing costs.
- Data Quality Guarantee: You are only charged for responses that successfully pass our automated quality and fraud checks (speed, attention, CAPTCHA). Low-quality responses are automatically filtered and not charged.
- Deposit Fees: Any processing fees charged by PayPal during the funding of your User Wallet are your sole responsibility.
- Campaign Funds: If you pause or stop a campaign, unused funds are immediately returned to your User Wallet and remain available for new campaigns.
- Withdrawal/Refund Fee: You may withdraw unused funds from your User Wallet to your external PayPal account at any time, subject to a 5% withdrawal fee, not to exceed $2.00 USD per transaction.
You agree to use the Service only for lawful purposes. You are solely responsible for the content of your surveys and any results derived from them.
You must not use the Service to conduct surveys or gather data that is illegal, defamatory, harassing, discriminatory, or violates the privacy rights of others. This includes content related to illegal acts, hate speech, or sensitive personal information (PII) without explicit consent.
You acknowledge that respondents are providing data in exchange for a reward. You agree not to manipulate or discourage honest participation. Any attempt to identify, contact, or violate the privacy of respondents outside of the Service is strictly prohibited.
All intellectual property rights in the Service (including the AI builder, design, software, and underlying platform technology) are owned by the Company.
You retain all ownership rights to the survey questions you create and the raw data collected specifically for your projects. You grant us a limited, non-exclusive license to use your questions and collected data solely for the purpose of operating, improving, and displaying the Service to you.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms, including failure to pay subscription fees or engagement in fraudulent activity.
The Service is provided on an "as-is" and "as-available" basis. We make no warranties, expressed or implied, regarding the Service, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of, or inability to access or use, the Service; (b) any conduct or content of any third party on the Service; or (c) any unauthorized access, use, or alteration of your transmissions or content.
These Terms shall be governed and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify users of material changes via email or an in-platform announcement. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
